I picked up an old retail copy of the game to play on my scaleo 400 (williamette celeron 1.7ghz + nVidia geforce 2 400mx win98, pretty much standard for 2002) pc and found that the game runs good after the standard installation.

There is also the v1.2 patch included on the CD, which fixes the controller problems for gamepads that have less than 10 buttons. After installing this patch however the game refuses to run, as seen in the attached image.
(Fyi, I'm running this oldskool, with the physical cd in the D:\ drive)

Has anyone seen this before?

You sure that sold out re-release version doesn't install the 1.2 version of the game straight up? Because it sounds to me like that version of the game either has different DRM or no DRM at all, and the official 1.2 patch installs an .exe which has a DRM which doesn't recognize the disc because it's not identical to the original.

Yes, it would be odd to add the official 1.2 patch installer to the disc if it already has it built in or has an incompatible drm, but I really wouldn't be all that surprised since we are talking about sold out here. I don't hold them in particularly high regard.

Yes, one thing that I did before installing the patch was that I extracted the patch files to another folder and compared the 'kain2.exe' file, which is a different size between the standard and patch versions. Also, when I ran the unpatched version there was a different loading screen that was unlike attached screenshot.

Another thing I did was reinstall the unpatched version from the disc, ran it to play a little and then I downloaded another copy of the 1.2 patch from the Internet... this also causes the same problem as the cd provided patch.
