I don't know of a dgv fix, but you can use elishacloud's dxwrapper:

That said, hardware mode won't make the game look better on modern computers. It was needed to make the game run better on slow CPUs back in the day. It's mostly 2D sprites.
The only difference is the beach is smoother in hw, but the downside is that you lose the water effects 🤣! And the 3D ship models don't even get any texture filtering in hw! And the fuzzy beach arguably looks better anyway!
So, software is the way to go.

thanks but this topic is mainly to warn Dege about a possible bug with dgvoodoo 2 so he can fix it if it's a bug.

Read the dxwrapper github thread. It's not a dgv bug. There's something unusual about how this game renders in hardware that causes this behavior.
