Eventhough i have it disabled in the control panel, NFS3 High Stakes, Mobil 1 Rally, 3dMark99 for example look like they are running capped FPS at 60 (NFS3) or 75 (3dMark99).
Any ideas?

RivaTuner => Set Vsync always off for Direct3D

Did that still the same. Viper Racing also locked at 50fps for some reason.
Quake 3 is fine but thats opengl.
Star Wars Racer is not capped.

WHen in game with NFS3 its capped at 60, when i press ESC to bring up the menu it becomes uncapped and FPS jump.
Weird.
