I wonder if this would be a set of ROM files and a emulator (i.e. Stella), somehow I doubt that will be the case.

I had a CD containing select Arcade and VCS "Classics", and they were more "simulators" than actual emulation.

That won't be the case. The original programmers worked for Atari and as employees anything they create falls under the Works for Hire section of copyright law. Whoever owns the rights to Atari's back catalog of games will be getting the money.
