Hello, sorry for opening a topic here. I live in Italy and I bought a game on ebay from US with delivery address in US, then it would have been forwarded to me.
The problem is that the seller instead of shipping it the day after as the listing declared waited more than a week, I sent the seller 3 messages but he never replied. Then when delivery time was almost expired he finally shipped the game with tracking code ( USPS Ground Advantage) the problem is that when it was finally out for delivery it has been forwarded to another address and now the item is returning to the sender.
I can dispute the order on ebay already but if I can't get the order, I would at least get my money back and I want to be sure to do it the right way.
I doubt it will be delivered on Tuesday since this part of the tracking updating every day saying the package was out for delivery without being actually delivered and now it's getting back.
What can I do to get the package or at least get my money back?

Open up a not received case on eBay. The seller will have 3 days to respond, and if not, then you should automatically receive a refund.

The eBay system may actually make you wait for a few more days as that has happened to me before.

Had one seller claim they had a family emergency when they took forever to ship and then didn't actually ship everything in the listing.

I put in a not as described case and ended up getting my money back the same day that the seller finally responded and said they were going to ship the missing things. I, of course, never received the missing items.

I also use a freight forwarder with a US address for my shipments. Unless the USPS marked the package as "delivered" you can open an Item Not Received case and eBay will definitely refund it.

Recently I had a different type of problem with a package that was marked as "delivered" at my forwarder address but they claim they never received it (which I tend to believe as I never had a problem with them after hundreds of shipments). The seller opened a missing mail request on USPS and it's still there since April 9, nothing happened so I kind of lost hope with that one.

Thank you both for the answer.
I will still wait Tuesday to see if will get delivered, otherwise I will open the dispute. Quite sad that there is apparently no chance to make them try the delivery on the forwarded address.
What should I write on the claim?

Edit: I just found a way to open a claim, that's what I get, I suppose there is no hope to get the package :\

I've had things I've sold on ebay go missing.
Never had a problem with the buyer opening a case.

The customer has to protect themselves, Up to the seller to case the delivery company for a refund (of which at lest in the UK ebay shipping will always only pay the shipping cost by default unless you point out by their own statement the entire cost is covered, depending on the service of course)

So I'm still fighting for this package. The problem is that usps faked the delivery for several day, now the tracking shows it's out for delivery since friday. The seller made fun of me and sent a message on friday saying it was on delivery that day, first message ever from him, I replied they just fake the delivery, no answer obviously.
If I will ask ebay to intervene, do I risk to do not get the refund since it show it's out for delivery?

I wouldn't think so. My experience with eBay refunds is they are pretty generous.

I even had them issue a refund once for a package which then showed up 2 weeks later.

As long as the package doesn't show as DELIVERED in the USPS tracker and you're past the expected delivery date you can open a case of Item Not Received and will most likely get a refund. Now, if it only shows Out for Delivery since Friday I'd recommend you wait a few days and see if the status changes, you may still get the package.

This looks more like an issue with the address you provided the package to be sent to in the US. Which is sus.
It would only be forwarded if that address has a forwarding address linked to it in the postal system.
And that forwarded address returned it as a return to sender cause they have no idea where or why they got the package.

This is completely not the sellers fault, they sent it to exactly where you instructed.
The USPS is just trying to figure out what to do with the package as it was rejected at the destination address and it's forwarded addressees.
So they are trying to get back to the sender (when this happens it does go to the regional hub first)
I see this as a problem of the destination address you provided.
And that is whom I would contract trying to get some answers. As to why the address given is getting forwarded, and then was rejected with a return to sender.

I'm in touch with the person, which is a vogons user and we speak daily. The problem may not be of the seller, other than he shipped it one week later than promised, but that being said. I blame usps.
If you watched the tracking evolution carefully you would have noticed that the package isn't going back to the seller, it gets bounced from a place to another.
They actually NEVER tried the delivery, the user waited the whole afternoon for the delivery and noone showed up.
On top of that both new and old address are checked daily and the user is receiving other packages, he also went to the post office several times and last time he spoke a manger that was unable to locate the package.
